Terms of Service

1. Acceptance of terms

By accessing or using the AIAH application and website at aiah.app (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.

2. Description of the Service

AIAH is an AI-powered personal wellness companion application. The Service provides conversational AI interactions, mood tracking, breathing exercises, weekly planning tools, and gamified engagement features. The Service is available as a progressive web app (PWA) and through native mobile applications.

Important: AIAH is not a medical device, therapy substitute, or healthcare provider. The AI companion provides general wellness support and should not replace professional mental health care. If you are experiencing a mental health crisis, please contact emergency services or a licensed professional.

3. Eligibility

You must be at least 16 years old to use the Service (age of digital consent in France under RGPD). By using the Service, you represent that you meet this requirement.

4. Account registration

To use the Service, you must create an account using Google OAuth or email magic link. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

5. Subscriptions and payments

AIAH offers paid subscription plans. By subscribing, you agree to the following:

• Subscription fees are billed in advance on a monthly or annual basis through Stripe.
• New subscriptions include a 7-day free trial. You will not be charged until the trial ends.
• You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
• Refunds are handled in accordance with Stripe's policies and applicable consumer protection law. EU consumers have a 14-day withdrawal right from the date of purchase, unless the service has been fully performed with your prior express consent.
• Prices may change with 30 days' notice by email.

6. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Attempt to reverse-engineer, decompile, or extract the AI models
• Use automated tools (bots, scrapers) to access the Service beyond normal usage
• Harass, abuse, or harm others through the Service
• Upload malicious content or attempt to compromise the Service's security
• Share your account credentials with third parties

7. Intellectual property

The Service, including its design, code, AI models, branding, and content, is owned by AIAH and protected by intellectual property laws. You retain ownership of the content you create (chat messages, plans, mood entries) but grant us a limited license to process this content solely to provide the Service.

8. AI-generated content

The AI companion generates responses using large language models. While we strive for helpful and accurate responses, AI-generated content may contain errors or inaccuracies. You acknowledge that AI responses are not professional advice (medical, legal, financial, or otherwise) and should not be relied upon as such.

9. Limitation of liability

To the maximum extent permitted by applicable law, AIAH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

This limitation does not affect your statutory rights as a consumer under EU or French law, which cannot be waived by contract.

10. Service availability

We aim to provide the Service 24/7 but do not guarantee uninterrupted availability. We may perform maintenance, updates, or suspend the Service temporarily. We will provide reasonable notice when possible.

11. Account termination

You may delete your account at any time via the app settings or at aiah.app/delete-account. We may suspend or terminate your account if you violate these Terms, with notice where reasonably possible.

12. Privacy

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your personal data in compliance with GDPR/RGPD.

13. Changes to these terms

We may modify these Terms at any time. Material changes will be communicated by email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

14. Governing law and disputes

These Terms are governed by French law. Any disputes shall be submitted to the competent courts of France. EU consumers may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
